Conditions of Hire

  1. Hirer
    The person, persons or corporate body making the application for the hire of the facilities will be deemed to be the HIRER throughout these Conditions.
  2. Applications
    Applications for the hire of the facility must be made in writing on the Official Application Form. Applications will be deemed to be provisional until the AQUARENA returns the Confirmation of Hire Form to the hirer.

    Provisional bookings will be held for a maximum period of 28 days. If the completed Application for Hire form has not been received by the Aquarena by that time the provisional booking will be cancelled and the date made available to other hirers.
  3. Payment
    1. Block Bookings
      Payment must be made monthly in advance for all hire dates within the monthly period following.
    2. Individual Hiring
      Payment must be made through the till in advance of the hire period or entry may be refused. Should additional charges be made (for over-running etc) and payment is not received within fourteen days of receiving notification of such charges the Council will hold the person completing the Application Form personally responsible for payment of the account.
  4. Cancellation
    1. Should the Hirer cancel the booking, the Hirer shall pay to the Council the full amount.  In the event of the facility being re-let the fee may be refunded less an administration charge.
    2. The Manager reserves the right to:
      • Refuse any application for booking without giving any reason for such a refusal.
      • Close or prohibit the use of any facilities if, at any time, in his opinion the facilities are unfit for use, in which circumstances the hire fee, or appropriate part thereof if only part of the facility is closed, shall be returned to the hirer.
      • Terminate the contract of hire forthwith, in the event of the hirer failing to comply with these conditions or failing to comply with the reasonable requests of the duly authorised officers of the Council.
    3. The Council will not be liable for any other expenditure incurred, or loss sustained directly or indirectly by the hirer arising from the cancellation of, or refusal of any application for the hire of the facilities therein.
  5. Catering
    1. Arrangements with regard to catering must be made with the Management as far in advance of the event as possible. Final arrangements must be made at least seven days in advance.
    2. No hirer may sell or allow to be sold on the premises refreshments, tobacco or goods of any description without the permission of Management.
  6. Exclusion of Liability of the Council
    1. The Council will not make good or accept any responsibility for the loss, theft or damage of or to goods or property of the Hirer or of any person, left deposited or put in to the Council’s premises. The Hirer shall indemnify the Council and their Officers and servants against all actions, expenses, claims, damages and demands arising out of or in any way connected with any such loss, theft or damage.
    2. In the event of any claim being made by any person in respect of any injury or damage or loss, sustained or incurred by any person while on the Council’s premises, the Hirer shall be responsible and shall indemnify the Council in respect of such claims provided that subject to sub-paragraph (a) above, the Hirer shall not be liable for any injury, damage or loss caused by the negligence of any Officer, or servant of the Council.
  7. Period of Hire
    The period of hire shall be as agreed between the Hirer and the Manager, such period being stated on the Application Form. The times stated are INCLUSIVE OF CHANGING TIME. A penalty charge will be enforced if the premises hired are not vacated on time. This will be one hour’s hire fee for the facility booked. In the case of block bookings the Contract of Hire will be reviewed with regard to termination of the contract of hire in certain circumstances by the Council.
  8. Dogs
    No dogs or other animals are allowed into the facility except with the express permission of the Manager.
  9. Conduct and Control
    1. The Hirer shall ensure that the premises are cleared of members of the public and left in a tidy and orderly condition at the end of the period of hire.
    2. No alterations, additions or fittings for any apparatus, equipment or decoration shall be carried out without prior permission from the Manager, which if granted, shall require the restoration and making good if any part of the premises is affected.
    3. No persons shall enter upon the bathside or surrounds in outdoor footwear and only duly authorised persons of Schools, Clubs or Organisations hiring the pool shall be allowed on the bathside and then only if wearing appropriate footwear approved by Management.
    4. The hirer shall not use or permit to be used in the pools canoes, boats or any similar floatable object, or any under-water swimming equipment without permission from the Manager.
  10. Management
    1. The Officers of the facility shall at all times during the hire period have free access to all areas for any purpose whatsoever.
    2. The hirer shall comply with all reasonable requests of the duly authorised Officers of the Council during the period of hire.
  11. Copyright
    The hirer shall be responsible for ensuring that no breach of any copyright shall occur and shall pay any fee in respect of copyright to the owner or to the Performing Rights Society Limited which may be necessary apart from such fee as may already have been paid by the Council.
  12. Extent of Premises Hired
    The extent of the premises and facilities hired shall be offered between the Hirer and the Manager, such details being stated on the application form.
  13. Damage
    The Hirer shall ensure that no loss or damage is caused to the facility, equipment, apparatus or furniture therein. The Hirer shall defray the cost of making good any damage arising out of the hiring and shall pay to the Council on demand the cost of repairing, replacing and reinstating any such damage caused during the hiring period. The amount of such loss to be certified b y the Borough Architect whose decision shall be final and binding.
  14. Hirer
    Any hire of the facility or part thereof shall be for the purpose specified on the application form. The Hirer is not entitled to allow any other person to use the facility or to grant any such rights of use to other than as stated on the Application Form.
  15. Supervision of Pools and Foyer Entrance
    1. The Hirer must provide at lease two qualified Lifeguards who will remain on the poolside throughout the period of hire. They must be clearly distinguishable from those using the pool. Lifeguards must hold a current RLSS Bronze Medallion qualification and the Hirer must produce evidence of such qualifications to the Management of the facility at least one week in advance of the hire period. The Lifeguards must visit the facility in advance of the hire period to familiarise themselves with First Aid provisions and resuscitation equipment.
    2. In addition to (15.1) above, one person must be provided by the Hirer to supervise and control the foyer entrance area to the building for the complete time of hire and use of the facilities.
  16. Broadcasting and Television
    No Hirer shall grant sound or television broadcasting, recording or filming rights without the prior written consent of the Manager. If such consent is given the Council reserves the right to be a party to any negotiations and to the Terms and Conditions of any agreement reached and to share any income and publicity derived therefrom.
  17. Insurance
    Hirers must have adequate insurance coverage and a copy of the Hirers Liability Insurance must be forwarded to the Manager at least seven days in advance of any period of hire. In the event that the Hirer does not have liability insurance an additional charge of 10% of the hire fee will be levied to cover insurance.
